Does the Treasury have limits on obtaining information from third parties?

ABSTRACT

Within the exercise of the control power carried out by the Tax Administration, as well as to achieve compliance with the goals set in tax collection, the Treasury permanently makes requirements to taxpayers, either to request information related to themselves and its activities as well as third parties with whom there is a business, corporate, family relationship, among others.

As a result of the compilation of the information, delivered by the tax-payer himself or by third parties, the Treasury carries out the processing of the same, trying to carry out the greatest number of crosses, as well as different algorithm techniques and big data, in order to find assumptions of Tax impact, with respect to operations not declared by the company.

However, assumptions may arise in which the Treasury exceeds the parameters of compliance with constitutional regulations, linked to the protection of the fundamental rights enshrined in the Political Constitution of Peru, in its desire to obtain information. Therefore It is necessary to analyze whether it is possible that the Tax Administration may require any type of tax information from taxpayers; in this case, it is necessary to analyze the application of the principle of proportionality.

RESUMEN

Dentro del ejercicio de la facultad de fiscalización realizada por la Administración Tributaria, igual que para lograr el cumplimiento de las metas trazadas en la recaudación tributaria, el fisco de manera permanente efectúa requerimientos a los contribuyentes, ya sea para solicitar información vinculada a ellos mismos y sus actividades como también a terceros con los cuales existe algún vínculo negocial, societario, familiar, entre otros.

Producto de la recopilación de la información, entregada por el propio contribuyente o por terceros, el fisco realiza el procesamiento de la misma, procurando realizar la mayor cantidad de cruces, al igual que distintas técnicas de algoritmos y big data, para lograr encontrar supuestos de afectación tributaria, respecto de operaciones no declaradas por el administrado.

Sin embargo, pueden presentarse supuestos en los cuales el fisco excede los parámetros de cumplimiento de normatividad constitucional, ligada a la protección de los derechos fundamentales

consagrados en la Constitución Política del Perú, en su afán de lograr la obtención de la información. Por ello resulta necesario analizar si es posible que la Administración Tributaria puede requerir cualquier tipo de información tributaria a los contribuyentes; siendo necesario analizar en este caso la aplicación del principio de proporcionalidad.
