Ofensiva contra prevaricadores. De forma conjunta, el Ministerio de Justicia y la Fiscalía denuncian a jueces de casos Sánchez Paredes y Luis Valdez.
De nada sirvieron las múltiples comisiones de reforma del Poder Judicial instaladas en los últimos años, pues los niveles de corrupción en ese poder del Estado –materializados a través de cuestionadas resoluciones– continúan escandalizando a la sociedad en su conjunto.
Ante el silencio –casi cómplice– de las altas esferas de la judicatura, el Ministerio de Justicia decidió informar sobre la ofensiva legal que ha desplegado para contrarrestar –o intentar, al menos– los fallos que han abierto las rejas a presuntos narcotraficantes.
RECHAZO INTERINSTITUCIONAL. El ministro de Justicia, Víctor García Toma, calificó de “barbaridades jurídicas” los sustentos de la Cuarta Sala Penal para Procesos con Reos en Cárcel para darle luz verde al pedido de los integrantes del clan Sánchez Paredes para que sean excluidos del proceso penal, en el cual son investigados por el presunto delito de lavado de dinero proveniente del narcotráfico.
Por ello, los jueces Carlos Ventura, Emilio Vigo y Aurora Quintana Gurt Chamorro fueron denunciados ante la Fiscalía Suprema de Control Interno por los delitos de prevaricato, abuso de autoridad y abocamiento ilegal.
“En el Poder Judicial hay nichos de corrupción, al grado que parecen haber confundido a los Sánchez Paredes con la familia Ingalls porque estas resoluciones, en realidad, parecen de película”, dijo el titular de la cartera de Justicia en conferencia de prensa.
A su lado, el director Nacional de Justicia, Daniel Figallo, le tomó la posta para decir que estos fallos producían indignación. “El caso Sánchez Paredes provocó una investigación profunda que involucró a 230 personas, entre naturales y jurídicas, y ahora esta Sala se la pretende traer abajo”.
A esta denuncia se añade el seguimiento a la investigación iniciada por la OCMA a los vocales, y el recurso de agravio constitucional presentado por el procurador del Ministerio Público, Aurelio Bazán, para que el caso llegue hasta el Tribunal Constitucional, previendo desde ya que los reclamos no tendrán eco en el Poder Judicial.
Mientras tanto, el titular de esa instancia, Javier Villa Stein, se mantuvo al margen y se abstuvo de cuestionar –como lo hace con decisiones de otras instituciones– a sus colegas.
SUELTO EN PLAZA. A la par del caso Sánchez Paredes, está la decisión del juez Omar Pimentel Calle, quien excarceló al ex alcalde de Coronel Portillo Luis Valdez, por un supuesto mal estado de salud –sin considerar las acusaciones que penden sobre él–, a quien se le ha detectado un desbalance patrimonial de más de US$10 millones.
“Esto ha producido una indignación en la defensa del Estado. De forma inaudita, la resolución que permite la excarcelación de Valdez recién ha sido notificada el miércoles a la procuradora Sonia Medina, esto produce una fundamentada sospecha sobre la labor de ese juzgado”, argumentó Figallo.
En tanto, ya lejos de las rejas carcelarias, Valdez –cuyo delicado estado de salud hacía peligrar su vida, según el juez Pimentel– ha planteado una apelación al arresto domiciliario que debe cumplir, así como a las medidas de conducta que deberá seguir. La procuradora del caso, Sonia Medina, informó que ya ha planteado la apelación respectiva a la decisión del juez.
