Desde la vigencia del Código Procesal Civil de 1993 se ha despertado en el Perú un especial interés, aun cuando todavía no suficiente, por el estudio del derecho procesal. Este especial interés supuso, inicialmente, una importante labor de formación de base, posteriormente discurrió hacia un estudio de los derechos procesales constitucionales hasta finalmente llegar al estudio de los problemas del derecho procesal contemporáneo. Por su puesto, en todo este periodo no faltan, qué duda cabe, los estudios exegéticos del Código.
Sin embargo, muchos de los temas clásicos, sí aquellos recurrentes, aquellos que ya casi se dan por sabidos, respecto de los que todos creen –con acierto o no- que ya está todo dicho, han sido olvidados. Éste no es sino sólo un intento por retomar uno de esos temas, revisarlo, estudiarlo y escribir sobre él.
No pretendemos en el presente trabajo realizar un análisis exhaustivo de la potestad jurisdiccional, pero debido a lo estrechamente vinculado que se encuentra este importante y complejo instituto procesal con el de la competencia, creemos necesario compartir con los lectores nuestra noción de jurisdicción.
La potestad jurisdiccional es aquella función atribuida constitucionalmente a algunos órganos del Estado por medio de la cual se busca la actuación del derecho objetivo al caso concreto a fin de lograr la efectiva tutela de las situaciones jurídicas de los particulares , la sanción de determinadas conductas antisociales y la efectividad del principio de jerarquía normativa por medio de decisiones definitivas y que son ejecutables; logrando con todo ello mantener la paz social en justicia.
De esta manera, la potestad jurisdiccional viene explicada desde el derecho procesal civil como una función del Estado que actúa a solicitud de los ciudadanos cuando aquella tutela jurídica prevista de manera general y abstracta por el derecho objetivo no ha sido actuada espontáneamente por los sujetos a quienes están dirigidas las normas jurídicas, procurando con ello la protección de las situaciones jurídicas de los particulares en aquellos casos en los que se haya producido esa crisis de cooperación.
III. Potestad jurisdiccional y competencia.
La potestad jurisdiccional es ejercida por aquellos órganos a los cuales la Constitución les confiere dicha potestad; sin embargo, ello no quiere decir que pueda ser ejercida en cualquier ámbito.
En efecto, si bien un Juez por el solo hecho de serlo ejerce función jurisdiccional, con todas las atribuciones que ella supone, su ejercicio se encuentra limitado legalmente en función a determinados criterios . De esta forma, la Constitución atribuye la jurisdicción, pero es la ley la que establece dentro de qué ámbitos es válido el ejercicio de la función jurisdiccional. La competencia, precisamente, tiene que ver con esos ámbitos en los que resulta válido el ejercicio de la función jurisdiccional.
Lo expuesto hasta el momento nos lleva a tener que precisar lo siguiente:
(i) No es posible ni correcto identificar “jurisdicción” con “competencia”. La noción de jurisdicción como ya ha sido reiteradamente dicho hasta aquí se refiere a una potestad estatal, mientras que la noción de “competencia” tiene que ver con los ámbitos dentro de los cuales el ejercicio de dicha facultad es válido . De esta forma, no es lo mismo decir que “un juez no tiene jurisdicción” y que “un juez no tiene competencia”, porque lo primero sería una contradicción en sí misma pues si un juez no tiene jurisdicción no es en realidad un juez. No tener jurisdicción supone no poder realizar actividad jurisdiccional (procesal) alguna, mientras que no tener competencia supone no poder realizar actividad procesal válida. Por ello, por ejemplo, una “sentencia” dictada por quien no ejerce función jurisdiccional entra dentro de la categoría de un “acto inexistente”, mientras que una sentencia dictada por un juez incompetente entra dentro de la categoría de un “acto nulo”.
Ahora bien, claro está que, en la medida que la competencia indica los ámbitos dentro de los cuales es válido el ejercicio de la función jurisdiccional, la jurisdicción se convierte en un presupuesto de la competencia, pues antes de entrar a analizar la competencia se hace preciso determinar si existe o no jurisdicción. Por ello, Calamandrei afirma que: “La cuestión “de competencia” surge, pues, lógicamente, como un posterius de la cuestión “de jurisdicción”” . La jurisdicción precisa quiénes tienen, en general, esa potestad constitucionalmente atribuida, mientras que la competencia precisa quién dentro de aquellos que tienen la función constitucionalmente atribuida puede, según la ley, conocer válidamente una causa en particular.
(ii) No es correcto afirmar que la competencia es una parte o porción de la jurisdicción. La labor que realiza la ley al momento de asignar competencia no supone seccionar una potestad compuesta por una serie de caracteres , pues sin uno de ellos aquello no sería potestad jurisdiccional. De esta forma, un juez ejerce a plenitud la potestad jurisdiccional, con todos los atributos que ella supone; sin embargo, esa potestad jurisdiccional que, reiteramos, la tiene a plenitud, no puede ser ejercida válidamente sino en determinados ámbitos que la ley señala sobre la base de determinados criterios que serán estudiados más adelante.
IV. Noción de competencia.
Las reglas de competencia tienen por finalidad establecer a qué juez, entre los muchos que existen, le debe ser propuesta una litis . Por ello, la necesidad del instituto de la competencia puede ser expresada en las siguientes palabras: “Si fuera factible pensar, aunque fuera imaginativamente, acerca de la posibilidad de que existiera un solo juez, no se daría el problema a exponer ahora, puesto que jurisdicción y competencia se identificarían” . Pero como ello no es posible, se hace preciso que se determinen los ámbitos dentro de los cuales puede ser ejercida válidamente, por esos varios jueces, la función jurisdiccional.
Por ello, definimos a la competencia como la aptitud que tiene un juez para ejercer válidamente la función jurisdiccional. De esta forma, la competencia es un presupuesto de validez de la relación jurídica procesal. Como lógica consecuencia de lo anterior, todo acto realizado por un juez incompetente será nulo .
V. Fundamento constitucional de la competencia.
Las reglas que rigen la competencia actúan la garantía constitucional del Juez natural , entendida ésta como el derecho que tienen las partes a que el conflicto de intereses o la incertidumbre jurídica sean resueltos por un tercero imparcial e independiente predeterminado por ley ; derecho que, además, integra el contenido del derecho a la tutela jurisdiccional efectiva. Esa predeterminación legal que forma parte del contenido de la garantía al Juez natural se expresa y actúa a través de la competencia.
En efecto, el solo reconocimiento del derecho a la tutela jurisdiccional efectiva como derecho fundamental y la trascendencia del mismo en el funcionamiento de un sistema democrático hace preciso el establecimiento legal del Juez ante quien dicho derecho sea ejercido. De esta forma, “la tutela pretendida por el actor frente al demandado ha de ser concedida por los jueces y tribunales y, también ante éstos, han de tener las partes su oportunidad de defensa” .
Por ello, se requiere una precisa regulación legal de la competencia; pues “solamente si está fijado antes de cada procedimiento con base en regulaciones abstractas, qué tribunal y qué juez es competente, se puede enfrentar el peligro de decisiones arbitrarias. Un firme régimen de competencia crea seguridad jurídica. El demandante sabe, a qué juzgado se puede o debe dirigir con su demanda. El demandado en todo caso se puede preparar, en qué lugar eventualmente debe contar con demandas” .
VI. Caracteres de la competencia.
Las características de la competencia son las siguientes:
VI.1. Es de orden público.
La competencia es un instituto de orden público en la medida que los criterios para asignarla se sustentan en razones de interés general . Nosotros consideramos que la competencia es de orden público por dos razones adicionales: (i) supone el desarrollo o actuación de un derecho fundamental (juez natural), y, (ii) sus reglas determinan el ámbito dentro del cual se ejerce una potestad asignada constitucionalmente a un órgano del Estado.
VI.2. Legalidad.
Las reglas de la competencia se fijan y determinan por ley . Esto no es sino una expresión más del derecho al Juez natural, pues, como ha sido expresado anteriormente, uno de los elementos que conforman el contenido de este derecho fundamental es que el Juez que conozca un caso debe ser el predeterminado por la ley, “con el fin de asegurar su plena independencia en el ejercicio de la potestad jurisdiccional ”. Este principio se encuentra establecido en el artículo 6 del Código Procesal Civil .
La legalidad tiene, sin embargo, una excepción: la competencia por razón del turno, en la medida que dicho criterio tiene que ver con la distribución interna del trabajo de los tribunales, razón por la cual deberá ser el propio Poder Judicial el que establezca este tipo de competencia .
VI.3. Improrrogabilidad.
Como hemos expresado anteriormente, la competencia es de orden público; ello trae como consecuencia el hecho que las normas que la determinan sean imperativas. Siendo ello así, las reglas que establecen y modifican la competencia se encuentran sustraídas de la voluntad de las partes debiéndose éstas atenerse a la competencia previamente determinada en la ley.
La improrrogabilidad rige para todos los criterios de determinación de la competencia, salvo para el criterio territorial. En efecto, el principio conforme al cual las partes no pueden modificar las reglas de competencia establecidas por la ley no se aplica en el caso de la competencia territorial, pues las partes sí pueden modificar las reglas de competencia territorial prevista por la ley, salvo algunas reglas de competencia territorial que, por disposición de la propia ley, no pueden ser modificadas . Es decir, si bien es cierto que, por regla general, la competencia no es prorrogable, en materia territorio sí lo es, salvo en aquellos casos en los que la ley disponga expresamente que la competencia territorial no sea prorrogable.
En materia territorial, la prórroga de la competencia puede ser expresa o tácita. Sin perjuicio de lo que más adelante expondremos, es importante señalar que la prórroga expresa es el acuerdo manifiesto de las partes a través del cual deciden someterse a un Juez distinto al previsto legalmente . Por su parte, la prórroga tácita se produce, para el demandante, cuando éste decide proponer su demanda ante un Juez distinto al previsto en la ley; mientras que, para el demandado, cuando comparece al proceso sin hacer reserva de ello o cuando deja transcurrir el plazo que tenía para cuestionar la competencia, sin hacerlo .
VI.4. Indelegabilidad.
Esta característica de la competencia es también una manifestación del carácter de orden público que tiene el instituto de la competencia. En efecto, en la medida que la competencia es de orden público, tiene que ser ejercida por el órgano al cual se le atribuye, no pudiendo ser delegada por su titular a otro distinto. Este principio ha sido expresamente recogido en nuestro Código Procesal Civil .
Ahora bien, ello no quita que, en algunos casos, un juez pueda comisionar la realización de algunos actos procesales a otro. Este fenómeno se conoce como el instituto de la comisión y no supone una delegación de competencia, sino sólo el encargo que recibe un juez de otro para realizar algunos actos procesales que, por razones fundamentalmente de orden práctico, el juez que comisiona no puede realizar. La comisión no es por ello una obligación del Juez, sino una facultad y así ha sido expresamente regulado en nuestro Código Procesal Civil .
Así por ejemplo, una diligencia a realizarse en una localidad distinta en la que se encuentra el Juez que conoce el proceso puede ser comisionada a otro Juez debido a que si el primero se traslada al lugar donde debe realizarse la diligencia desatenderá sus deberes en los demás procesos. Debe tenerse en cuenta que la razón de la comisión no radica en el hecho que el Juez que conoce el proceso no es competente para realizar actos procesales derivados del proceso que conoce (y respecto del cual sí es competente) en otro distrito judicial, sino en una cuestión meramente práctica. Por ello, el instituto de la comisión no tiene que ver en realidad con un problema de competencia, sino con la colaboración y facilitación del ejercicio de la función jurisdiccional.
Otro ejemplo de comisión es la notificación por exhorto. De esta manera, cuando un juez remite un exhorto para que otro juez sea el que notifique, lo hace no porque no sea competente para notificar en otro distrito judicial, sino porque al no tener los instrumentos para hacerlo, solicita a otro juez de igual grado que lo diligencie; sirviendo ello, repetimos, como un mero instituto de colaboración judicial. Por ello, es válida la notificación realizada, obviando el trámite de la comisión, por el Juez competente que conoce del proceso a quien domicilia en un distrito judicial distinto a aquel en el que tiene competencia el mencionado Juez, más aún si dicho acto ha cumplido su finalidad.
En materia probatoria la comisión debe ser excepcional, ello atendiendo al principio de inmediación procesal. Así, sobre la base de la equivocada percepción que se tiene respecto a la comisión, muchos jueces creen que si ellos realizan una inspección judicial en un lugar donde no son competentes, dicha diligencia sería inválida, debiéndolo hacer el Juez competente en ese lugar. Nada más absurdo, pues si ello fuera así se perdería la finalidad que se desea alcanzar con una prueba tan importante como la inspección judicial. Por ello, la inspección judicial debe ser realizada por el Juez que conoce el proceso, salvo que sea sumamente difícil o peligroso hacerlo.
VI.5. Inmodificabilidad o perpetuatio iurisdictionis
VI.5.1. Noción y momento de determinación de la competencia.
Esta es otra de las características de la competencia estrechamente vinculada al derecho al Juez natural. En este caso tiene que ver con la predeterminación del Juez que debe conocer el proceso. Según esta característica, una vez que la competencia ha sido determinada, ella no puede variar en el transcurso del proceso, aun cuando varíen las circunstancias de hecho o de derecho que sirvieron para determinarla . La razón de ello es evitar cualquier tipo de injerencia en los procesos a través de intencionados cambios de jueces que se pudieran producir, lo que pondría en riesgo las garantías de imparcialidad e independencia de los jueces.
Para poder comprender esta característica se hace necesario, entonces, establecer en qué momento se determina la competencia. Son dos básicamente las soluciones que propone la doctrina para establecer cuál es el momento para la determinación de la competencia: (i) la determinación del Juez se hace en función de las normas sobre competencia que estuvieron vigentes al momento de la realización de los hechos que se han de juzgar y (ii) la determinación del Juez se hace en función de las normas sobre competencia vigentes al momento de la interposición de la demanda .
La primera de las soluciones es una opción de “inequívoco sabor penalista” fundamentalmente porque se establece un paralelismo con la irretroactividad de las normas penales materiales respecto de la comisión del delito. Además de ello, esta solución supone una confusión entre el objeto de regulación de las normas procesales y el de las normas materiales.
La segunda de las soluciones citadas fija el momento de la determinación de la competencia atendiendo al momento del inicio del proceso. Lo trascendente para esta opción no es qué norma sobre competencia estuvo vigente al momento de la realización de los hechos a juzgar (lo que, por lo demás, resultaría muchas veces difícil, en especial, en aquellos casos en los que exista acumulación objetiva sucesiva), sino que lo trascendente es determinar qué normas sobre competencia estuvieron vigentes al momento del inicio del proceso. Con esta solución se pone en evidencia, además, el diferente objeto de regulación de la norma de derecho material y de la norma de derecho procesal. Esta es la solución adoptada por nuestro Código Procesal Civil en su artículo 8 .
Si decimos que el Código Procesal Civil ha adoptado el criterio según el cual la competencia se determina en función de las circunstancias de hecho o de derecho existentes al momento de presentar la demanda, resulta claro que, una vez ocurrido esto, la competencia no puede ser modificada, pues eso es lo que reza el artículo 8 del Código Procesal Civil. Sin embargo, el artículo 438 inciso 1 del Código Procesal Civil establece que uno de los efectos del emplazamiento es que la competencia inicial no podrá modificarse aunque varíen las circunstancias que la determinaron. La pregunta que nos hacemos entonces es: ¿Qué competencia no puede variarse aquella que existía al momento de la interposición de la demanda o aquella que existía al momento del emplazamiento? ¿Cómo compatibilizar lo dispuesto en el artículo 8 del Código Procesal Civil con lo establecido por el inciso 1 del artículo 438 del mismo Código?
La cuestión que proponemos es importante en aquellos casos de sucesión de normas en el tiempo porque puede ocurrir que una vez presentada la demanda y antes de producido el emplazamiento se modifique la norma que establece la competencia; siendo ello así, si se interpreta que el artículo 438 inciso 1 del Código Procesal Civil establece que sólo después de producido el emplazamiento la competencia no puede modificarse, ello quiere decir entonces que la nueva norma podría ser aplicada al proceso en trámite, variándose con ello la competencia establecida al momento de la interposición de la demanda. A nuestro entender la competencia que no puede ser modificada es la fijada al momento de la interposición de la demanda, pues ese es el principio recogido expresamente en el artículo 8 del Código Procesal Civil y que garantiza de mejor manera los fines que se desean alcanzar con el derecho al Juez natural: la predeterminación legal y, con ella, la independencia e imparcialidad de los jueces.
Si ello es así ¿cómo interpretar lo dispuesto por el inciso 1 del artículo 438 de nuestro Código? Creemos que, desde el derecho a la tutela jurisdiccional efectiva (respeto a la garantía del juez natural) existen dos interpretaciones posibles, una desde la perspectiva del legislador y otra desde la perspectiva del demandante: (i) dicha norma es una ratificación de lo establecido en el artículo 8 del Código Procesal Civil, al disponerse que la competencia inicial (es decir, aquella establecida al momento de la interposición de la demanda) no podrá ser modificada por el legislador, ni antes ni después de producido el emplazamiento; y, (ii) por el solo emplazamiento la demanda en general, y como tal la competencia, no pueden ser modificadas por el demandante . Esas son interpretaciones a las que se llega, además, a partir del derecho al Juez natural, pues si entendemos que dicho derecho supone, entre otras cosas, el derecho a un Juez predeterminado, ello quiere decir que el Juez tiene que estar establecido antes del inicio del proceso, es decir, antes de la interposición de la demanda, de otra forma no puede ser entendida la palabra “predeterminado”. Esta interpretación, entonces, es una interpretación que resulta conforme a la Constitución, al derecho a la tutela jurisdiccional efectiva (entendiendo al Juez natural como manifestación de ella) y mantiene inalterable el principio contenido en el artículo 8 del Código Procesal Civil.
Una vez dejado establecido que la competencia fijada al momento de la interposición de la demanda no puede ser modificada, debemos preguntarnos ahora cómo se relaciona la inmodificabilidad de la competencia con la aplicación de la norma procesal en el tiempo.
VI.5.2. Perpetuatio iurisdictionis y aplicación de la ley procesal en el tiempo.
Sabido es que el principio que rige la aplicación de las normas procesales en el tiempo es el principio de aplicación inmediata de la norma, de forma tal que la nueva ley se aplica, incluso, a los procesos en trámite. Si el principio de aplicación de las normas procesales supone la aplicación inmediata de la norma al proceso en trámite ello querría decir que si la nueva norma es una que regula competencia, ésta debería aplicarse al proceso ya en trámite, con lo cual sería posible la modificación de la competencia. Si ello es así, se dejaría de lado la inmodificabilidad de la competencia. De ser ello así se produciría un conflicto entre el principio de aplicación inmediata de las normas procesales y el de la inmodificabilidad de la competencia, conflicto que es resuelto dando primacía a la perpetuatio iurisdictionis . De esta forma, podemos decir que, si bien las normas procesales se aplican de manera inmediata, incluso a los procesos en trámite, ello es así, salvo que la nueva norma sea una que modifica la competencia, pues en estos casos, prima el principio de inmodificabilidad de la competencia, rigiéndose la competencia por la norma anterior, es decir, por aquella que estuvo vigente al momento de la interposición de la demanda. Esta es la solución por la que ha optado nuestro Código Procesal Civil .
VI.5.3. ¿Es un principio que admite excepciones?
Hasta ahora hemos venido diciendo que el derecho al Juez natural dispone, entre otras cosas, que el Juez que conoce un proceso debe ser predeterminado por la ley. Es decir, que el Juez sea establecido antes del inicio del proceso. De esta forma, la competencia se determina en función de las circunstancias de hecho y de derecho existentes al momento de la interposición de la demanda, sin que los cambios producidos en ellas puedan afectar a la competencia ya fijada, todo esto en aplicación del principio de la perpetuatio iurisdictionis.
¿Pero ese principio puede tener algunas excepciones? Una primera respuesta nos llevaría a decir que si lo que se quiere con la perpetuatio iurisdictionis es precisamente evitar la modificación de la competencia porque con ella se vulneraría la independencia e imparcialidad del Juez, entendidas como componentes del derecho al Juez natural, entonces, no puede tener excepciones. Sin embargo, la cuestión en la doctrina no ha sido pacífica. En efecto, hay quienes sostienen que la predeterminación legal del Juez (que no es sino el sustento de la perpetuatio iurisdictionis) puede sufrir algunas excepciones, en virtud de los siguientes criterios : (i) aceptar de forma absoluta la perpetuatio iurisdictionis traería consecuencias prácticas negativas porque evitaría cualquier intento de reforma judicial integral ya que se impediría la modificación de los órganos jurisdiccionales que vienen conociendo los casos actuales; y, (ii) se debe aceptar la posibilidad de una excepción a la regla en aquellos casos en los cuales la competencia fijada en la nueva norma sea más favorable que la anterior. En nuestra opinión ninguna de estas dos razones justifican establecer excepciones al carácter de la inmodificabilidad de la competencia. Respecto a la reforma judicial, la gravedad y profundidad de la reforma que supondría una situación como la que coloca la doctrina la hace tan absolutamente excepcional que resulta difícil pensar en ella como una excepción al principio; por ello, no creemos que una situación tan extrema como la propuesta pueda justificar admitir una excepción al principio de perpetuatio iurisdictionis, por lo demás, lo expuesto se podría salvar a través de disposiciones transitorias. Respecto a que debe admitirse una excepción a dicho principio cuando la competencia dispuesta por la nueva norma sea más favorable que la anterior, opinamos que no existe competencia más o menos favorable; que lo más favorable para todos los ciudadanos y para el correcto funcionamiento de las garantías ante la jurisdicción, es que el Juez que conozca un caso sea aquél establecido por la ley con anterioridad al inicio del proceso, sin que ninguna modificación en las circunstancias de hecho o de derecho puedan justificar un cambio en las normas que regulan la competencia.
Quizá sólo sea posible admitir una excepción a este principio en aquellos casos en los que el conocimiento del proceso por el Juez predeterminado por la ley pueda afectar su imparcialidad. Como hemos dicho, la inmodificabilidad de la competencia tiene como finalidad garantizar la independencia e imparcialidad del Juez; por ello, si por alguna razón (causas de conmoción social, por ejemplo) la imparcialidad del juez está en juego, puede procederse a la modificación de la competencia. Esta excepción precisamente surgirá para garantizar aquello que la propia regla de la inmodificabilidad protege: la independencia e imparcialidad de los jueces .
Por ello, cuando se entiende que el derecho a un Juez natural supone el derecho a un Juez “pre-determinado”, ello quiere decir que una vez establecido éste no puede modificarse. La claridad del mandato contenido en el inciso 3 del artículo 139 de la Constitución es bastante claro y no admite excepción alguna, cuando se señala que ninguna persona puede ser desviada de la “jurisdicción predeterminada por la ley”. Admitir una excepción a la perpetuatio iurisdictionis ahí donde el mandato constitucional es claro y no la admite, supondría una afectación de dicho derecho. La única excepción posible tendría que sustentarse en situaciones en las cuales mantener al Juez predeterminado por la ley, podría suponer una afectación a los principios de imparcialidad e independencia judiciales. Por ello, somos de la opinión que la última parte del artículo 8 del Código Procesal Civil es muy peligrosa al contener una previsión tan general de la posibilidad de excepciones a la regla de la inmodificabilidad de la competencia.
VII. Criterios o factores para la determinación de la competencia.
Hemos venido diciendo que la competencia es la aptitud que tiene un juez para ejercer válidamente la función jurisdiccional. Esa aptitud está dada en función de determinados criterios conforme a los cuales se asigna competencia. Hay varias clasificaciones y denominaciones usadas en doctrina para distinguir estos criterios, nosotros hemos optado por una muy uniforme y que pretende simplificar la explicación de los mismos. Esos criterios son: materia, cuantía, grado, territorio y turno.
VII.1. Competencia por razón de la materia.
Para Carnelutti, la competencia por razón de la materia “tiene que ver con el modo de ser del litigio” . Es decir, la competencia por razón de la materia se determina en función de la relación jurídica que subyace al conflicto de intereses o a la incertidumbre jurídica que sirven de sustrato al proceso y, en especial, por la pretensión y/o pretensiones que, respecto de ese conflicto o esa incertidumbre, se plantean en el proceso.
Por ello, para proceder a la determinación de este criterio de la competencia, se hace preciso analizar los elementos de la pretensión planteada en el proceso, es decir, tanto el petitum como la causa petendi. El petitum a fin de establecer qué efecto jurídico es el que busca el demandante que le otorgue el órgano jurisdiccional y la causa petendi a fin de establecer los hechos que delimitan el contenido de la pretensión, entre los cuales está, por cierto, la relación jurídica que subyace al conflicto. Ese es, en cierta forma, el criterio que adopta el Código Procesal Civil, al momento de establecer qué se entiende por este criterio de determinación de competencia . Nada importa, a efectos de establecer la competencia por razón de la materia, el valor económico de la pretensión.
La razón que está detrás de este criterio es lograr la especialización de los tribunales. En ese sentido, en el Perú existen jueces en función de las siguientes materias: civil, penal, laboral, contencioso administrativa y de familia. Esto, sin embargo, es absolutamente variable y depende del nivel de especialización con el que se quiere contar en la solución de una pretensión así como del distrito judicial respectivo.
VII.2. Competencia por razón de la función.
Para Leible “en la competencia funcional se trata de la distribución de diversas obligaciones jurisdiccionales en una causa a diversos órganos de la jurisdicción”.
Es decir, iniciado un proceso, diversos órganos jurisdiccionales pueden estar llamados a conocer diversos asuntos respecto de él o, para decirlo en otros términos, distintas fases o etapas del proceso pueden estar asignadas a conocimiento de diversos órganos jurisdiccionales. De esta forma, esos diversos asuntos, etapas o fases del proceso a los que los diversos órganos jurisdiccionales están llamados a conocer es lo que se conoce como competencia funcional.
Por ello, Ortells señala que: “La competencia funcional es la atribución a cada uno de los órganos jurisdiccionales que han de ejercer su potestad en un determinado proceso de cada una de las específicas funciones que, a cada uno de ellos, corresponde realizar en ese proceso” .
Ahora bien, por regla general al Juez que le corresponde conocer del proceso le corresponde conocer también sus incidencias; pero es perfectamente posible que la ley señale que eso no sea así, sino que algunas incidencias puedan ser conocidas por órganos jurisdiccionales distintos.
En función de esas incidencias que pueden estar asignadas a diversos órganos jurisdiccionales se hace una distinción entre competencia funcional vertical y competencia funcional horizontal.
La competencia funcional vertical supone una asignación de atribuciones establecida en la ley acerca de a quién le corresponde el conocimiento del primer o segundo examen de una resolución judicial. Según este criterio, se realiza una división entre juez a quo y juez ad quem. Al primero de ellos se le asigna el primer conocimiento del asunto, correspondiéndole su estudio y resolución; es, en otras palabras, el primer grado. Al segundo de ellos, se le asigna el segundo conocimiento del asunto, correspondiéndole la revisión de aquello que ha sido resuelto por el a quo y su confirmación , revocación o anulación dependiendo de si encuentra o no errada la resolución del a quo y, de ser el caso, la determinación del tipo de error en el que se incurre. Así por ejemplo, si un proceso se lleva ante el Juez de Paz los recursos de apelación interpuestos contra las resoluciones expedidas por él, serán de conocimiento del Juez Especializado en lo Civil. De otro lado, si un proceso se lleva ante un Juez Especializado en lo Civil, los recursos de apelación interpuestos contra las resoluciones expedidas por él, serán de conocimiento de la Sala Civil de la Corte Superior respectiva.
La competencia funcional horizontal supone una asignación de atribuciones establecidas en la ley respecto de diversas fases del proceso (como por ejemplo, si la ley estableciera que la ejecución de una sentencia le corresponda a un juez distinto de aquél a quien la dictó y conoció del proceso) o, la atribución del conocimiento de un incidente o un aspecto relacionado al proceso a un órgano jurisdiccional distinto a aquel que conoce el proceso. En este último caso se trata de un incidente no originado a consecuencia de la solicitud de un doble conocimiento de una misma decisión, de lo contrario, nos encontraríamos ante un supuesto de competencia funcional vertical, sino, de un incidente que, aunque, asignado a un órgano superior, le corresponde a él porque así lo establece la ley. Un ejemplo de esto último puede ser la competencia que se le asigna a la Sala Civil de la Corte Superior respectiva para conocer del conflicto de competencia producido entre dos órganos del mismo distrito judicial o, la asignación de competencia que se le da a la Sala Civil de la Corte Suprema para conocer del conflicto de competencia producido entre órganos jurisdiccionales de distritos judiciales distintos . Otro ejemplo de esto último es la asignación de atribuciones a los diversos órganos jurisdiccionales en los casos de impedimento de jueces y recusación .
VII.3. Competencia por razón de la cuantía.
VII.3.1. Justificación de este criterio.
Existe una relación clara entre la importancia económica del litigio y el esfuerzo necesario para obtener su composición . La adaptación del costo del proceso a la importancia económica del litigio influye, según Carnelutti , no sólo sobre la naturaleza de los actos del proceso, sino también sobre la estructura de los órganos jurisdiccionales: “es conveniente para los pleitos de menor importancia un oficio menos costoso” (entendemos menor importancia, como menor valor económico, no como menor trascendencia).
Similar opinión mantiene Calamandrei, para quien: “Puesto que la justicia exige gastos tanto más graves cuanto más numerosas sean las personas que integren el juzgador y cuanto más complicado y largo sea el procedimiento, se ha reconocido la conveniencia de hacer que a las causas de menor importancia económica respondan órganos judiciales más simples, que permitan una mayor economía de personas y de tiempo, y reduzcan el costo del proceso a una medida que no parezca desproporcionada con el valor de la causa” .
Resulta evidente pues, que la determinación de la competencia en función del valor económico del petitorio (cuantía) tiene una justificación económica en el sentido que se quiere asignar a oficios y tipos de procesos que representen menor costo para el Estado y los particulares, los procesos relativos a litigios de menor costo; ello para que ni los particulares ni el Estado tengan que soportar con el proceso un mayor costo que aquél que representa en sí el conflicto de intereses que con él se quiere evitar o resolver.
VII.3.2. Noción de cuantía.
La cuantía es un criterio de determinación de la competencia en función del valor económico del conflicto sometido a conocimiento del órgano jurisdiccional.
Ahora bien, el artículo 10 del Código Procesal Civil señala que la competencia por razón de la cuantía se determina en función del valor económico del petitorio. El tema que corresponde analizar ahora es cómo se determina el valor económico del petitorio. Rocco señala que existen tres sistemas para determinar el valor económico del petitorio:
a) El sistema según el cual la cuantía se determina en función de la declaración del demandante en su demanda.
b) El sistema según el cual se deja en el Juez la apreciación del valor del asunto.
c) El sistema según el cual la determinación del valor se encuentra establecido en la ley en función de determinadas presunciones.
Respecto de todos y cada uno de los sistemas anteriormente descritos se pueden formular críticas pues todos ellos tienen ventajas y desventajas; lo trascendente es que, siendo la cuantía un criterio objetivo de determinación de la competencia “debe negarse, por consiguiente, cualquier importancia a otros factores de carácter personal y subjetivo. Así, no podrá tenerse en cuenta la valoración personal y afectiva de determinado sujeto (…)” .
Ahora bien, el Código Procesal Civil ha recogido el primero de los sistemas, es decir, aquél según el cual la cuantía se determina en función de lo que el demandante ha afirmado en su demanda, aun cuando admite que el Juez puede corregir la cuantía expuesta por el demandante sólo si aprecia de lo expuesto por el propio demandante (sea de la demanda o de los anexos de ésta) que ha habido un error en la determinación de la cuantía. Es importante anotar que ello no quiere decir que nuestro Código haya optado por el segundo sistema, sino que mantiene el primero de ellos, lo que ocurre es que permite al Juez realizar una especie de corrección del valor de la cuantía expuesto por el demandante en función de lo que el propio demandante señala o adjunta como anexos. Siempre son la declaración y los documentos que adjunta el demandante, los que son determinantes para la determinación de la competencia por razón de la cuantía.
Ahora bien, nuestro Código Procesal Civil establece algunas reglas para la determinación de la cuantía, las mismas que procedemos a describir a continuación:
1. Para calcular la cuantía se suma el valor del objeto principal de la pretensión, los frutos, intereses y gastos, daños y perjuicios y demás conceptos devengados al momento de la interposición de la demanda, no los futuros.
2. Si una demanda contiene varias pretensiones la cuantía se determina por la suma del valor de todas.
3. Si en una demanda se plantean pretensiones subordinadas o alternativas se atenderá a la que tiene mayor valor para efecto de determinar la cuantía.
4. Si son varios los demandados la cuantía será determinada en función del valor total de lo demandado.
5. Si se plantean pretensiones sobre derechos reales sobre inmuebles, la cuantía se determina en función al valor que tiene el inmueble a la fecha de la interposición de la demanda.
6. Es competente para conocer la pretensión accesoria el Juez de la pretensión principal, aun cuando, consideradas individualmente, no alcancen o excedan el límite de la cuantía establecida para la competencia del Juez.
VII.4. Competencia por razón del territorio.
La competencia por razón del territorio supone una distribución de los procesos entre diversos jueces del mismo grado, a fin de hacer que el proceso se lleve ante aquel Juez que por su sede resulte ser el más idóneo para conocer de una pretensión en concreto .
Siendo ello así, la competencia por razón del territorio se establece en virtud de diversos criterios que tienen que ver, fundamentalmente, con la vecindad de la sede del Juez con el objeto, personas o demás elementos del conflicto de intereses. Estos diversos criterios para la determinación de la competencia territorial reciben el nombre de fueros y éstos son:
VII.4.1. Fuero personal (forum personae).
Este criterio está determinado por el lugar en el que se encuentran las personas que participan en el proceso como parte . De esta forma, lo que normalmente ocurre es que las partes del proceso tengan domicilios distintos, en cuyo caso habrá que observar el domicilio del demandante y del demandado y definir entre ellos qué juez es el competente. Esta definición está dada por una regla general de competencia, denominada forum rei, según la cual es competente el Juez del lugar del domicilio del demandado; regla que se encuentra recogida en nuestro Código Procesal Civil en más de una oportunidad .
La regla del forum rei supone, pues, una clara opción por favorecer la posición del demandado, pues es el Juez de su domicilio el que, por regla general, resulta competente. La razón de ello es explicada por la doctrina en los siguientes términos: siendo que el demandado se encuentra obligado a participar en el proceso por voluntad del demandante, se posibilita comparecer ante el Juez de su domicilio para favorecer el ejercicio de su derecho de defensa. Sin embargo, existen algunos supuestos en el que el mantenimiento de esta regla general podría originar serios perjuicios para el demandante, pues una regla de competencia como la del forum rei, puede suponer una barrera al acceso a la jurisdicción del demandante, especialmente en aquellos casos en los que dicha regla genere una excesiva carga para el demandante al tener que trasladarse hasta el domicilio del demandado a fin de iniciar un proceso. Ese es el caso, por ejemplo, de los procesos de alimentos, en los que, de mantenerse la regla general expuesta, supondría una terrible e infranqueable barrera al acceso a la jurisdicción, razón por la cual en estos casos se quiebra la regla, otorgando al demandante la posibilidad de demandar ante su propio Juez .
VII.4.2. Fuero real (forum rei sitae).
Este criterio para establecer competencia tiene su justificación en el hecho que se desea aproximar al Juez a los elementos del conflicto y, en concreto, al lugar en el que se ubica el bien respecto del cual se discute en el proceso . Este criterio es de aplicación sólo en el caso en que se discuta sobre derechos reales respecto de inmuebles.
VII.4.3. Fuero causal.
Este criterio se refiere, independientemente de la ubicación de las personas o del bien discutido, al lugar donde se produjo el hecho que constituye su fundamento . De esta forma, se hace una distinción entre forum obligationis (lugar donde surge la obligación o donde se produce la causa de la obligación) y forum executionis (lugar donde debía ejecutarse la obligación).
VII.4.4. Fuero instrumental.
Este criterio establece el Juez competente atendiendo al lugar donde la ley presume que se encuentra o se puede encontrar el mayor material probatorio para resolver una controversia.
VII.4.5. Competencia facultativa.
Los criterios enunciados anteriormente no son necesariamente excluyentes, pues si bien la regla general en materia de competencia por razón del territorio es el forum rei, la ley otorga en algunos casos la posibilidad para que el demandante demande ante un Juez distinto al del lugar del domicilio del demandado, el que se encuentra igualmente habilitado (es competente) para conocer el proceso. Los casos de competencia facultativa se encuentra expresamente previstos en el artículo 24 del Código Procesal Civil .
VII.5. Competencia por razón del turno.
La competencia por razón del turno es un criterio de asignación de competencia que tiene que ver con la distribución del trabajo entre los diversos tribunales. De esta manera, el Poder Judicial determina los criterios de asignación de procesos a los diversos jueces que garanticen el ordenado ingreso de procesos a un determinado despacho.
VIII. Prórroga de la competencia.
Como hemos explicado anteriormente, por regla general, la competencia es improrrogable, salvo la competencia por razón del territorio. Por ello, todo lo que en esta sede se indique se referirá a este criterio de determinación de la competencia y, siempre que, no exista ley que establezca que en un específico supuesto, la competencia territorial sea improrrogable.
La prórroga de la competencia o competencia por elección como la llama un sector de la doctrina “se funda en la convicción de la utilidad que puede tener el acuerdo de las partes como índice de la idoneidad, respecto del litigio, de un oficio diverso del determinado según las normas de la competencia principal” . De esta forma, la ley permite que, respecto del territorio, las partes puedan establecer una competencia distinta a la prevista en la ley.
La razón de que sea la competencia por razón del territorio aquella respecto de la cual se pueda pactar se debe, según Calamandrei , a que normalmente esas reglas son establecidas en interés de las partes, siendo ello así, ellas pueden, con un acuerdo, establecer una competencia distinta a la prevista legalmente.
Ahora bien, algo que debe tenerse en cuenta es el hecho que la prórroga de la competencia requiere siempre de la voluntad de los dos sujetos , no bastando para ello que sólo uno manifieste su voluntad en ese sentido.
El acuerdo respecto de la competencia puede concluirse antes o después de nacido el conflicto de intereses. En función de ello, este acuerdo puede ser:
VIII.1. Acuerdo preventivo (ante litem natam).
Es un acuerdo de prórroga al que llegan las partes antes del inicio del conflicto, estableciendo ante qué juez se llevará a cabo el eventual proceso que se inicie en caso surja algún conflicto entre ellas.
Este acuerdo se produce normalmente como una cláusula dentro de un contrato (cláusula de competencia). La cláusula de competencia debe ser realizada por escrito, no siendo importante al efecto que el acuerdo conste expresado en un mismo documento o en más de uno; siendo suficiente que la declaración de voluntades concurrentes conste por escrito (es el caso, por ejemplo, de dos partes que expresan su voluntad en sendas cartas cursadas entre ellas).
Cabe precisar que este acuerdo no forma parte del objeto del contrato, sino que se hace con ocasión del mismo .
Ahora bien, a través de este acuerdo, las partes pueden ampliar la competencia establecida en la ley o derogar la competencia principal. En el primer caso, las partes establecen, adicionalmente a la competencia del Juez prevista legalmente, otro ante el cual podrían demandar. En el segundo caso, las partes establecen que el Juez establecido en la ley no será el competente, sino que lo será aquél que las propias partes pacten. Para que esto último sea posible, se hace necesario que conste expresamente la voluntad de las partes en el sentido que la competencia atribuida por ellos en el acuerdo es exclusiva. Así lo expresa la doctrina: “El acuerdo vale para atribuir competencia al Juez elegido, no para privar de competencia al Juez elegido según ley; pero si en el acuerdo expreso se atribuye al Juez elegido competencia exclusiva, el Juez designado por la ley no es competente” .
Ello quiere decir que, si en el acuerdo de las partes no se ha establecido con absoluta claridad que la competencia que se asigna es exclusiva, la competencia por ellas acordada es una competencia adicional a la prevista en la ley constituyéndose, entonces con este acuerdo, una competencia facultativa, donde el demandante puede optar elegir entre el Juez previsto en la ley como competente o el previsto por las partes en el acuerdo.
Finalmente, debe tenerse en cuenta el hecho que, a pesar que las partes han pactado que un determinado Juez sea el competente (sea ampliando la competencia o sea derogando la legalmente establecida), si el demandante demanda ante un Juez diverso al pactado y el demandado no cuestiona la competencia oportunamente, se puede producir una prórroga tácita de la competencia .
Este tipo de prórroga está regulado en el artículo 25 del Código Procesal Civil .
VIII.2. Acuerdo sucesivo (post litem natam).
En este caso el acuerdo se produce luego de surgido el conflicto de intereses. El acuerdo puede ser expreso o tácito.
VIII.2.1. Acuerdo sucesivo expreso.
Es un acuerdo de prórroga al que llegan las partes luego del surgimiento del conflicto, estableciendo ante qué juez se llevará a cabo el eventual proceso que se inicie para resolver el conflicto entre ellas. Así lo explica la doctrina: “(…) puede ocurrir aunque la hipótesis sea muy rara que, nacido el litigio y antes de que las partes lo lleven al proceso, se pongan de acuerdo, mediante declaraciones recíprocas, para someterlo a juicio de un oficio que no tendría competencia (…)” .
A este tipo de acuerdo se le aplica lo expuesto para el acuerdo preventivo.
VIII.2.2. Acuerdo sucesivo tácito.
Se produce en aquellos casos en los cuales el demandante interpone su demanda ante un Juez que, de acuerdo a las normas de competencia no sería el competente, y el demandado (habiendo sido válidamente notificado) deja transcurrir el plazo previsto en la ley para cuestionar su competencia, sin hacerlo.
Este tipo de prórroga se encuentra previsto en el artículo 26 del Código Procesal Civil .
IX. La competencia por conexión.
La competencia por conexión se presenta en todos aquellos casos en los cuales hay dos o más pretensiones conexas. Dos o más pretensiones son conexas cuando tienen en común, al menos, uno de sus elementos (petitum o causa petendi) . En estos casos la ley permite que esas pretensiones que son conexas puedan ser acumuladas, es decir, puedan ser reunidas en un mismo proceso para que el Juez pueda pronunciarse respecto de ellas en un mismo proceso favoreciendo con ello la economía procesal y evitando el dictado de fallos contradictorios.
Ahora bien, la acumulación no encuentra ninguna dificultad si las pretensiones son competencia de un mismo Juez; el problema se presenta en aquellos casos en los cuales la competencia respecto de las pretensiones que se quieren acumular corresponde a Jueces diversos. En estos casos, señala Liebmann, la acumulación no es posible, salvo que se elimine ese obstáculo .
La manera como se eliminan esos obstáculos es expresada por Liebmann en los siguientes términos: “Por ello las reglas de la competencia ceden en parte el paso a las exigencias de la simultaneidad del proceso y sufren algunas modificaciones, en el sentido que una de las acciones conexas pueda ser propuesta ante el juez competente para la otra, antes que ante aquél que sería competente según las normas ordinarias. Tales modificaciones son, sin embargo, posibles sólo para la competencia por razón del territorio y para la competencia por razón del valor; las reglas de la competencia por la materia y funcional son más rígidas y no admiten derogación, ni siquiera respecto a la conexidad” .
Nótese entonces que las reglas de la competencia por razón del territorio o por razón de la cuantía ceden ante la necesidad de acumular pretensiones. En eso consiste la competencia por conexión. Algunos ejemplos de lo que decimos se pueden encontrar en nuestro Código Procesal Civil:
1. Si se demanda a varios demandados que tengan domicilios distintos, es competente el Juez del lugar de cualquiera de ellos (artículo 16 del Código Procesal Civil) .
2. Si se demanda una pretensión de garantía (aseguramiento de pretensión futura) el Juez competente para conocer de esta pretensión será el Juez competente para el conocimiento de la pretensión principal a fin de que sea decidida en el mismo proceso, aun cuando por razón del territorio y del valor no le corresponda su conocimiento (artículo 32 del Código Procesal Civil).
3. Si se demanda una pretensión accesoria (es decir, una pretensión que sigue la suerte de la principal) el Juez competente para el conocimiento de la accesoria es el competente para conocer la principal, aun cuando por razón del territorio o del valor no lo sea (artículo 32 del Código Procesal Civil). Así se ha manifestado la doctrina cuando afirma que: “la conexión por accesoriedad importa, en consecuencia, la atracción de la demanda accesoria al juez competente para aquella principal, aunque corresponda por territorio a la competencia de otro Juez y en el caso indicado sin límite del valor” .
X. Cuestionamiento de la incompetencia.
La competencia es un presupuesto procesal y, como tal, su presencia, como la de los demás presupuestos procesales, determina la validez de la relación jurídica procesal. Si en un proceso no existe competencia, este hecho puede ser denunciado o puesto de manifiesto a través de los siguientes mecanismos:
X.1. De oficio.
El Juez puede declararse incompetente en todos aquellos casos de competencia improrrogable. Esa facultad se encuentra expresamente prevista en el inciso 4 del artículo 427 del Código Procesal Civil , pero la misma debe ser ejercida única y exclusivamente respecto de aquellos casos, repetimos, de competencia improrrogable, como se desprende lo establecido en el primer párrafo del artículo 35 del Código Procesal Civil .
X.2. A pedido de parte.
Las partes pueden denunciar la incompetencia del Juez, a través de dos medios de defensa. Cabe precisar que, por disposición del artículo 37 del Código Procesal el uso de uno de los siguientes mecanismos, excluye la posibilidad de utilizar el otro.
X.2.1. Excepción de incompetencia.
Recordemos que las excepciones son medios de defensa típicos a través de los cuales el demandado, en ejercicio de su derecho de defensa, cuestiona la ausencia o presencia defectuosa de un presupuesto procesal o una condición de la acción. Una de las excepciones previstas en nuestro Código Procesal Civil es la excepción de incompetencia (artículo 446 inciso 1 del Código Procesal Civil) . A través de este mecanismo, el demandado acude donde el Juez incompetente que está conociendo el proceso y cuestiona su propia competencia, esperando un pronunciamiento de dicho Juez sobre ella.
X.2.2. Inhibitoria.
A través de este mecanismo, el demandado en un proceso ante un Juez incompetente acude donde el Juez que sí es el competente para solicitarle que se declare competente y le solicite al Juez incompetente que le remita el proceso. Este mecanismo de defensa del demandado se encuentra regulado en nuestro Código Procesal Civil .
XI. Conflicto o contienda de competencia.
Se produce un conflicto o contienda de competencia en todos aquellos casos en los cuales dos jueces consideran ser o no ser competentes para conocer de un determinado asunto. En el primer supuesto se habla de conflicto positivo y en el segundo, se habla de conflicto negativo.
En el conflicto positivo dos jueces creen ser competentes para conocer de determinado asunto, lo que se podría presentar, por ejemplo, en aquellos casos en los que el demandado haya planteado una inhibitoria y tanto el Juez ante el que la interpuso como el Juez que conoce el proceso se consideran competentes .
En el conflicto negativo dos jueces creen no ser los competentes para conocer de un determinado asunto, lo que se podría presentar, por ejemplo, en todos aquellos casos en los cuales el demandado interponga una excepción de incompetencia y el Juez que conoce el proceso la declare fundada, remitiendo el proceso al Juez que éste considera que es el competente; quien al recibir el proceso se declara también incompetente. Puede también presentarse en aquellos casos en los cuales el Juez se declare incompetente de oficio y, a consecuencia de ello, remita el proceso ante el Juez que él considere competente, quien al recibir el proceso se declara también incompetente .
Los conflictos positivo y negativo de competencia son resueltos por el órgano jurisdiccional superior.
XII. Palabras finales.
No hemos pretendido agotar todo el tema de la competencia, habiéndosenos quedado en el tintero muchos otros temas relacionados con este instituto. Sólo hemos pretendido aproximar al lector a este tradicional instituto desde su vertiente constitucional (jurisdicción y juez natural), para luego describir las reglas que regulan la competencia.

Un juez puede cambiar la orden de detención por comparecencia cuando esta recusado? tengo por entenido que no puede ar fin al proceso, pero no estoy segura si puede variar la media, ahora por otro lado se tiene la opinión de la fiscaia como archivo definitivo en otras palabras no hay delito que perseguir.
la recusaciòn tiene por objeto impugnar legítimamente la actuación de un juez en un proceso, cuando una parte considera que no es apto porque su imparcialidad está en duda, por lo tanto no es idóneo para variar la medida. tal vez este comentario te sirva.

1.- Nos hallamos ante una competencia objetiva cuando es la materia lo que determina la actuación del juez.
