Tratamiento Jurídico del Patrimonio Cultural de propiedad de la Iglesia Católica en el Perú

En el Perú los bienes culturales de propiedad de la Iglesia Católica en virtud del Acuerdo entre la Santa Sede y la Republica del Perú, tienen un tratamiento jurídico especial, tal cual lo exponemos a continuación.

  1. Sobre el Acuerdo entre la Santa Sede y la Republica del Perú

El 25 de julio de 1980 se emitió el Decreto Ley N 23211, mediante el cual se aprobó el Acuerdo entre la Santa Sede y la Republica del Perú, según el cual se normo en entre otras disposiciones lo siguiente:

Articulo 1.-La Iglesia Católica en el Perú́ goza de plena independencia y autonomía (…)

Artículo 2.-La Iglesia Católica en el Perú continua gozando de la personería jurídica de carácter público, con plena capacidad y libertad para la adquisición y disposición de bienes, así́ como para recibir ayudas del exterior.

Artículo 10.-La Iglesia Católica y las jurisdicciones y comunidades religiosas que la integran continuarán gozando de las exoneraciones y beneficios tributarios y franquicias que les otorgan las leyes y normas legales vigentes.

Sobre la personería jurídica de carácter publico referida en el articulo 2, precisamos que:

Los Estados soberanos del mundo son con moderna terminología (…), calificados como personas de derecho público. [1]

  1. Sobre la Resolución Directoral Nacional N° 958/ INC

Mediante la referida resolución, el 20 de junio de 2006 el Instituto Nacional de Cultura (Ahora Ministerio de Cultura) declaró Patrimonio Cultural de la Nación a diversos tipos de bienes de la Iglesia Católica del Perú de las épocas colonial y republicana.

  1. Sobre la Resolución Directoral Nacional N° 1232/ INC

El 25 de setiembre de 2007, mediante la resolución antes referida el Instituto Nacional de Cultura (Ahora Ministerio de Cultura) dispuso lo siguiente:

Artículo 1°.- Dejar sin efecto la Resolución Directoral Nacional N° 958/INC del 20 de junio de 2006(…)

Artículo 2°.- Señala que, los bienes de propiedad de la Iglesia Católica que reúnan las condiciones señaladas en el artículo II de la Ley No 28296 se encuentran bajo el amparo de la misma en concordancia con su régimen canónico y lo dispuesto en el Acuerdo Internacional suscrito entre la Santa Sede y la República del Perú.

  1. A modo de colofón

Considerando lo dispuesto en el articulo 2 del Acuerdo entre la Santa Sede y la Republica del Perú, en el sentido que la Iglesia Católica en el Perú tiene la condición de Sujeto de Derecho Internacional Publico, colegimos que se genera una ficción jurídica, según la cual, la Iglesia Católica en el Perú, es un Estado (Iglesia Católica) dentro de otro Estado (Perú).

Lo antes expuesto, es ratificado por lo dispuesto en el articulo 2 de la Resolución Directoral Nacional N° 1232/ INC, en el cual se señala que los bienes de propiedad de la Iglesia Católica que reúnan las condiciones señaladas en el artículo II de la Ley No 28296, se encuentran bajo el amparo de la misma en concordancia con su régimen canónico y lo dispuesto en el Acuerdo Internacional suscrito entre la Santa Sede y la República del Perú.

 

Considerando lo antes expuesto estaríamos antes un supuesto de falta de competencia del Estado Peruano, para otorgar la condición de bienes integrantes del Patrimonio Cultural de la Nación peruana a los bienes culturales de propiedad de la Iglesia Católica dentro del Territorio peruano.

Juridical Treatment of the Cultural Heritage, property of the Catholic Church in Peru

In Peru the cultural goods, property of the Catholic Church by virtue of the Agreement between the Holy See and the Republic of Peru, have a specia juridical treatment, as we expose it below:

 

  1. On the Agreement between the Holy See and the Republic of Peru

On July 25, 1980 wasissuedDecreeLawN23211, which approved the Agreement between the Holy See and the Republic of Peru, and norm in between other dispositions, the following thing:

Articule 1.- The Catholic Church in Peru, enjoy of full independence and autonomy (…)

Article 2.- The Catholic Church in Peru continue enjoying the legal status of public character, with full capacity and freedom for the acquisition and disposition of goods, as for receiving help from outside.

Article 10.- The Catholic Church and the jurisdictions and religious communities that integrate it will continue enjoying the exonerations and tributary benefits and exemptions that grant them the laws and legal regulations.

On the juridical legal status of public character recounted in the article 2, we need that:

The sovereign States of the world are with modern terminology (…), qualified as persons of public law. [1]

  1. About National Directoral ResolutionN° 958/ INC

By the mentioned resolution on June 20, 2006 the National Institute of Culture (Now Minister of Culture) declared Cultural Heritage of the Nation to diverse types of goods of the Catholic Church of Perú, from de republican and colonial epochs.

  1. About National Directoral ResolutionN° 1232/ INC

On 25 of September of 2007, by the resolution before recounted the National Institute of Culture (Now Minister of Culture) arranged the following thing:

Article 1°.-Leaves without effect the National Directoral ResolutionN° 958/INC del 20 de junio de 2006(…)

Artícle 2°.- Indicates that, the goods property of the Catholic Church thatassemble the conditionsindicated in the Article II of the Law N° 28296, are under the protection of the same one in accordance with their jcanonical regime, dispose in the International Agreement signed between the Holy See and the Republic of Peru.

  1. Like Colophon

Considering the prevition of the Artícle 2° of the Agreement between the Holy See and the Republic of Peru, in the sense that the Catholic Church in Peru has the condition of Subject of Public International Law, we collect that there is generated a juridical fiction, according to which, the Catholic Church in Peru is a State (Catholic Church) inside another State (Peru).

 

The above, is ratified by the provisionsin the Article 2° of theNational Directoral Resolution N° 1232/INC, which indicates that the goods of property of the Catholic Church that should assemble the conditions indicatedin the Article II of the Law N° 28296, meet under the protection of the same one, in conformity with his canonical regime and arranged in the International Agreement signed between the Holy See and the Republic of Peru.

Considering the expose before, we would be before a supposition of alleged lack of jurisdiction of the Peruvian Government, to grant the condition of integral goods of the Cultural Heritage of the Peruvian Nation to the cultural goods of property of the Catholic Church inside the Peruvian Territory.
