What is Antichresis?

In the civil law. A species of mortgage, or pledge of immovables. An agreement by which the debtor gives to the creditor the income from the property which he has pledged, in lieu of the interest on his debt. Guyot, Repert.; Marquise De Portes v. Hurlbut, 44 N. J. Eq. 517. 14 Atl. S91. A debtor may give as security for his debt any immovable which belongs to hitn, the creditor having the right to enjoy the use of It on account of the interest due, or of the capital if there is no interest due; this is called “antichresis.” Civ. Code Mex. art. 1927. By the law of Louisiana, there are two kinds of pledges, the pawn, when a movable is given as security, and the antichresis, when the security given consists in immovables or real estate. Under the latter the creditor acquires the right to take the rents and profits of the land, and to credit, annually, the same to the interest, and the surplus to the principal of the debt, and is bound to keep the estate in repair, and to pay the taxes. Origen etimológico de la palabra: proviene de la palabra latina medieval antichresis, y este a su vez de la palabra griega antigua ἀντίχρησις (antíchrēsis), de ἀντί (antí, “en cambio”), y χρῆσις (chrẽsis, “uso”), de χράω (chráō, “usar”).

Anticresis y enfiteusis

En el contrato de enfiteusis, el enfiteuta recibe un fundo sobre el cual tiene un derecho de goce que, entre otras cosas, permite al acreedor percibir los frutos del inmueble. Pero, a diferencia de la anticresis, es un elemento esencial del contrato la obligación de mejorar el fundo y la de pagar un canon. Ademas, la enfiteusis puede ser perpetua y cuando no se establece su duración, se presume la perpetuidad; nace a favor del enfiteuta un derecho real y puede disponer del fundo y rescatarlo; también tiene la obligación de sufragar y pagar los impuestos y demás cargas que existan sobre el fundo. En la anticresis el acreedor ejerce el derecho de goce limitado a percibir los frutos que tiene sobre el inmueble, con el propósito de satisfacer una deuda preexistente y no tiene la obligación de mejorar el fundo, ni de pagar un canon. Si bien el acreedor tiene obligación de pagar las contribuciones y pensiones a que este sujeto el inmueble y de hacer las reparaciones necesarias, tal obligación consiste solamente en realizar los actos necesarios para lograr esas finalidades, pero no corren por su cuenta esos gastos y, por el contrario, puede deducirlos del valor de los frutos del inmueble antes de efectuar la imputación. Por otra parte, la anticresis nunca puede constituirse a perpetuidad.
